Welcome to the ScaleCare website (the “Site”), operated by ScaleCare Corp (“ScaleCare,” “we,” “our,” or “us”). By accessing or using the Site, you agree to these Terms & Conditions (“Terms”). If you do not agree, do not use the Site.

1) What the Site Provides

The Site provides information about ScaleCare and may allow you to submit information to:

  • request connection to home care/home health agencies, and/or
  • express caregiver/job interest, and/or
  • inquire about ScaleCare services as an agency or business.

2) No Medical Advice

Content on the Site is for general informational purposes only and is not medical advice, diagnosis, or treatment. Always seek advice from qualified professionals regarding medical conditions or care decisions.

3) ScaleCare Is Not a Care Provider

ScaleCare is not a home care provider, home health agency, medical provider, or insurer. We do not deliver clinical services and do not guarantee that an Agency Partner will accept a case, have availability, or provide any specific outcome.

4) User Responsibilities

You agree that any information you submit is accurate and that you have the right to provide it. You agree not to:

  • use the Site for unlawful purposes
  • submit false, misleading, or fraudulent information
  • attempt to access systems or data without authorization
  • interfere with Site functionality or security (including introducing malware)

5) Communications (Calls, Email, SMS)

If you provide your contact information, you agree that ScaleCare and/or Agency Partners may contact you using the information you provided, including by phone, email, and text message, consistent with applicable law and your preferences. Message and data rates may apply. You can opt out of SMS by replying STOP (where applicable).

6) Third-Party Sites and Agency Partners

The Site may contain links to third-party sites. We do not control and are not responsible for third-party content, policies, or practices.

Agency Partners are independent businesses. Any services you receive from an Agency Partner are provided under that Agency Partner’s terms and policies.

7) User-Generated Content

If you submit reviews, testimonials, or other content, you grant ScaleCare a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content for business purposes (e.g., marketing), unless prohibited by law. You represent you have the rights to submit the content and that it does not violate any laws or third-party rights.

8) Intellectual Property

All Site content (text, graphics, logos, design, and other materials) is owned by or licensed to ScaleCare and protected by applicable intellectual property laws. You may not copy, modify, distribute, or exploit Site content without written permission, except as allowed by law.

9) Disclaimers

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or secure.

10) Limitation of Liability

To the maximum extent permitted by law, ScaleCare will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of the Site or your interactions with Agency Partners.

11) Indemnification

You agree to indemnify and hold harmless ScaleCare from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your violation of these Terms, or your submission of information/content that infringes third-party rights or violates law.

12) Changes to the Site and Terms

We may modify or discontinue the Site at any time. We may update these Terms from time to time by posting an updated version. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

13) Governing Law / Venue

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of laws principles. Venue for disputes shall be in Philadelphia County, Pennsylvania, unless otherwise required by law.

SMS Program Terms

Program name: ScaleCare SMS Program

Program purpose: ScaleCare sends SMS/MMS messages to individuals who request help finding home care services. Messages may include request confirmation, basic non-sensitive intake questions (e.g., ZIP code, schedule, general service needs), status updates, and coordination of next steps, including connecting you with an independent partner home care agency that may be able to serve you.

How you opt in

You can opt in to receive text messages from ScaleCare by:
  • Submitting your phone number on a ScaleCare web form and checking an SMS consent checkbox (not pre-checked), or
  • Providing verbal consent during a phone call with a ScaleCare representative (for example, when you request updates by text).  By opting in, you authorize ScaleCare to send recurring SMS/MMS messages to the phone number you provide.

Message frequency

Message frequency varies based on your request and activity, but you can generally expect 1–5 messages per week while your request is active.

Opt-out (STOP)

You can cancel at any time by replying STOP to any message. After you send STOP, you may receive one final message confirming your opt-out, and then you will no longer receive messages from that program/number unless you opt back in.

Supported carriers / delivery

Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your network operator and device compatibility.

ScaleCare’s Privacy Policy explains how we collect, use, and protect your information: Privacy Policy. We use your information to provide and improve our services, including responding to your request and coordinating next steps.

No sensitive information by SMS

Do not send sensitive personal, medical, or financial information via text message. If sensitive information is needed, ScaleCare will provide an alternate method to share it.

Eligibility

The SMS Program is intended for U.S. phone numbers. You represent that you are the account holder or have permission from the account holder to enroll the provided phone number.

We may update these SMS Program Terms from time to time. Updates will be posted on this page, and your continued participation constitutes acceptance of the updated terms.
